2Tier Music Privacy Notice

2Tier Music is a product of NightIron Software LLC, an Arizona limited liability company doing business as 2Tier Music ("2Tier," "we," "us," or "our"). This Privacy Notice explains how we handle personal information when you use the 2Tier Music Windows Desktop application, Android Companion, website, licensing services, customer support, and other services that link to this Notice.

1. Local-First Design

2Tier Music is designed as a local-first music management system. Your personal music library is not uploaded to or hosted in a 2Tier Music cloud service.

Music files, folder paths, playlists, artwork, library metadata, application settings, synchronization indexes, local caches, and similar music-library information are generally processed and stored on your own devices. Transfers between the Windows Desktop application and Android Companion are intended to occur directly over your local network.

We do not sell, stream, license, or host your music.

Information may leave your device when you intentionally send us a message, screenshot, diagnostic information, or other material for customer support, or when you use a third-party service that independently processes information under its own terms.

2. Information We May Receive

Depending on the 2Tier Music features you use, we may receive:

• License keys, license status, activation information, machine labels, and related licensing information. When a machine identifier is used for licensing, we store a one-way cryptographic hash of the machine identifier, not the raw identifier.
• Dates and times associated with license activation, verification, renewal, deactivation, rejection, revocation, restoration, trial creation, and related licensing events.
• Internet Protocol addresses, request times, security logs, and limited technical information generated when your device communicates with our servers.
• Information you voluntarily provide when contacting us, including your name, email address, messages, screenshots, files, or diagnostic information.
• Website request information ordinarily generated by our web server, such as IP address, request time, requested page, and technical request information.
• Purchase and transaction information when purchasing 2Tier Music products, such as name, email address, transaction identifier, product purchased, purchase amount, payment status, and applicable billing or tax information.

The 2Tier Music Desktop application reads and indexes music files, folder paths, metadata, playlists, and related library information on your device in order to build and manage your music library. This processing occurs locally on your device. The 2Tier licensing service does not need to receive or access the contents of your personal music library.

Our current website does not use advertising or behavioral-tracking systems.

3. Payment Information

When direct online purchases are made available, payment-card information will be handled by our disclosed payment processor.

2Tier Music will not receive or store full payment-card numbers or card security codes. The applicable payment processor will process that information directly.

We will update this Privacy Notice to identify the payment provider before live customer payments are accepted.

4. How We Use Information

We use information we receive to operate and protect 2Tier Music, including creating and managing licenses and trials, verifying authorized devices, preventing license abuse and fraud, delivering purchases, providing customer support, troubleshooting technical problems, maintaining and securing our servers, communicating with customers, and maintaining appropriate business, accounting, tax, security, and legal records.

Where applicable law requires a particular legal basis for processing, our processing may be based on performing our contract with you, complying with legal obligations, protecting legitimate business and security interests, or your consent where consent is required.

5. Service Providers and Sharing

We do not sell your personal information.

Our current service providers that may process information in connection with 2Tier Music include Amazon Web Services (AWS), which provides website and server infrastructure, and Google Workspace, which provides business email and related communications services.

We may provide service providers only the information reasonably necessary for them to perform their services. Those providers also operate according to their own terms and privacy practices.

We may disclose information when reasonably necessary to comply with applicable law or lawful legal process, protect users or systems, investigate fraud or security incidents, enforce our agreements, or as part of a merger, financing, sale, reorganization, or transfer of the business or product.

6. Data Retention

We retain personal information only as long as reasonably necessary for the purposes for which it was collected, including licensing and trial administration, customer support, fraud prevention, security, accounting, tax, legal compliance, disputes, and operation of the Services.

License-related records may be retained for the life of a license and for an additional period reasonably necessary for business, security, tax, fraud-prevention, or legal purposes. Support communications and security records may have different retention periods depending on operational needs and legal obligations.

7. Security

We use administrative and technical safeguards appropriate to the information we process. Our current safeguards include encrypted HTTPS connections, restricted administrative access, SSH key-based server authentication, firewall protection, automated protection against repeated unauthorized login attempts, and encrypted storage for sensitive server data.

Our licensing application is not directly exposed to the public Internet; public requests are handled through our web server and forwarded to the licensing service over the server's local interface.

No method of electronic storage or transmission can be guaranteed to be completely secure. If a security incident involving personal information requires notification under applicable law, we will provide the required notice.

Security vulnerabilities concerning 2Tier Music may be reported to security@2tiermusic.com.

8. Your Privacy Choices and Rights

Depending on where you live, you may have rights relating to your personal information, including rights to request access, correction, deletion, or other actions provided by applicable law.

Some information may need to be retained even after a request, including information required for licensing, transactions, accounting, taxes, security, fraud prevention, legal compliance, or dispute resolution.

You may contact us about privacy rights at privacy@2tiermusic.com. We will not discriminate against you for exercising privacy rights available to you under applicable law.

9. Children

The 2Tier Music website, commercial licensing service, purchase process, Windows Desktop application, and Android Companion are not directed to children under 13.

We do not knowingly collect personal information from children under 13 in violation of applicable law. If we learn that such information has been collected unlawfully, we will take reasonable steps to delete it.

Purchases and acceptance of the 2Tier Music legal agreement must be completed by an adult or another person legally authorized to enter into the transaction or agreement.

10. International Processing

2Tier Music is operated from the United States. Information received by 2Tier may be processed in the United States and in other locations where our service providers operate. Privacy rights and requirements may differ depending on where you live.

11. Changes to This Privacy Notice

We may update this Privacy Notice as 2Tier Music changes, as service providers are added or removed, or as our legal obligations change.

When we update the Notice, we will change the effective date or version shown at the top. Material changes will be communicated when appropriate or required by law.
